Lawyer Minimum Wage Tariff (AAÜT) is published by TBB every year in January. It determines the minimum fees that the lawyer can charge.
Types of Tariff
- Minimum wage between client and lawyer
- Attorney's fee to be ordered by the court
- Attorney's fee to be charged to the other party
Attorney's Attorney's Fee
The losing party pays attorney's fee to the lawyer of the winning party. This fee is calculated on AAÜT.
Calculation
- In cases involving money, it is a percentage of the case value
- Fixed tariff in cases that do not involve money (e.g. divorce case)
- Special rates in enforcement proceedings
Supreme Court of Appeals HGK
HGK determines that the attorney fee is "according to the case value" It is accepted that it should be calculated, but the judge can use his/her discretion in cases with symbolic value. The contract cannot be below AAÜT.
