- Crimes within the jurisdiction of first instance criminal law: 1 year + 6 months extension
- Within the jurisdiction of high criminal penalty crimes: 2 years + 3 years extension
- Terror crimes: up to 7 years
Judicial Control Priority
CMK article 109 regulates that judicial control measures should be used instead of arrest. Measures such as travel bans, signatures, house arrest, electronic handcuffs should be preferred.
Constitutional Court Approach
The Constitutional Court considers detention exceeding a reasonable period as a violation of the right to personal freedom (Constitution Art. 19) and awards compensation.
