TMK Art. 129-133 regulates the conditions and obstacles to marriage.
Age (TMK Article 124)
- Man and woman must be 17 years old
- The judge may allow the marriage of a man or woman who is 16 years old in extraordinary circumstances and for a very important reason.
Mental Health (TMK art. 125)
Those who do not have the power of discrimination cannot marry.
Random (TMK art.129)
- Superior and descendant lineage (mother and father and child; grandfather and grandchild)
- Siblings (one parent, one mother, father a)
- Uncle-nephew, uncle-nephew, aunt-nephew, aunt-nephew
- Adoptor and his/her descendants
Current Marriage (TMK article 130)
A married person cannot remarry (polygamy ban).
Period of waiting period (TMK article 132)
Woman 300 days waiting period after divorce.
Sanction
- Annulment of marriage due to absolute nullity (TMK art. 145)
- In some cases (mental health, kinship) it cannot be resolved later
Supreme Court 2. HD
2. HD accepts that the obstacle to marriage due to kinship is "absolute and irreparable" and that this marriage can be annulled at any time.
