İYUK Article 7: An action for annulment is filed within 60 days from the notification of the administrative action.

  • Contrary to the elements of authority, form, reason, subject, purpose
  • Contrary to law
  • Contrary to public interest

  • Open unlawfulness
  • Irreparable damage
  • Court makes immediate decision

Process

  1. Suit in the administrative court
  2. Defense of the administration
  3. Decision (1-2 years)
  4. Appeal BAM (30 days)
  5. Appeal to the Council of State
