Personality rights are rights that protect the person as a whole as a human being. It is regulated in TMK art. 23-25.
Scope of Personal Rights
- Life, health, physical integrity
- Honour, dignity, reputation
- Private life and secret
- Name, surname
- Picture and image
- Freedom of thought and belief
Protection Cases (TMK Art. 25)
- Case to prevent the attack: If there is a danger of attack
- Case to stop the attack: If the attack continues together)
Precautionary Measure
During the attack, the court may decide on immediate precautionary measure.
Supreme Court HGK
HGK stated that the "unlawfulness" element of the attack on personal rights is important, but other rights such as freedom of the press, freedom of expression should be balanced.
Legal Entities
Legal entities also have the right to request protection of reputation (title, brand) and personal rights regarding their field of activity.
