Social media account theft is one of the cyber crimes that has become widespread in recent years. TCK Article 243 (entering the information system) and if the conditions are met, TCK Article 245 (bank/credit card crimes) and Article 158/1-f (fraud via information system) can be applied.
Account Stealing Methods
- Phishing (phishing e-mail/site)
- SIM swap (number transfer from the operator)
- Brute force (password attempts)
- Password matching from leaked databases
- Downloading a fake application (malware)
What the Victim Should Do
- Complaint to the platform about "account stolen" (Instagram: account/recover; Facebook: m/cp)
- Change the e-mail and phone number linked to the account
- Close all authorized sessions
- Activate 2FA
- Notify your relatives (fake messages may be sent)
- File a criminal complaint to the public prosecutor's office
- If the bank password is the same, change it immediately
SIM Swap Prevention
- Have an "additional security password" defined by your operator
- Use application-based 2FA, not via SMS (Google Authenticator)
Supreme Court 8. CD
8. CD accepts that stealing a social media account may constitute TCK Article 243/1 the crime of breaking into the information system, and sharing messages/content that will harm the victim through the account may constitute TCK Article 158/1-f fraud or TCK Article 125 insult crimes.
