Limitation Periods in Turkish Law: General List

Prescription is the period prescribed by law for the exercise of rights. If the period is missed, the right cannot be exercised.

TBK (Debts) Statute of Limitations

  • General statute of limitations: 10 years (TBK art.146)
  • Rent, interest, other periodic receivables arising from the contract: 5 years (Art.147)
  • Tort: 2 years before learning the damage and the perpetrator, in any case. 10 years (Art. 72)
  • Unjust enrichment: 2 years/10 years (Art. 82)
  • Traffic accident compensation: 2 years/10 years

TMK (Civil) Statute of Limitations

  • Sharing of the inheritance: 10 years
  • Cancellation of the will: 1 year/10 year
  • Tenkis: 1 year/10 years
  • Change of custody: no time period
  • Liquidation of property regime: 10 years

TTK (Commerce) Statute of Limitations

  • Commercial sale: 6 months (disgrace), 2 years (general)
  • General assembly cancellation: 3 months
  • Presentation of check/bill duration: check 10 days, bond 3 years
  • Insurance compensation: 2 years/10 years

Labour Law Statute of Limitations

  • Work receivables (wage, notice, severance): 5 years
  • Work accident compensation: 10 years

TCK Lawsuit Statute of Limitations

  • According to the type of penalty Between 5-30 years
  • Aggravated life imprisonment, life imprisonment: 30 years

KVKK

  • Objection to administrative fine: 30 days

Administrative Jurisdiction

  • Cancellation case: 60 days
  • Tax case: 30 days
