KTK article 48: Driving with alcohol over 0.50 promil will result in administrative sanctions, causing an accident/death/injury will result in criminal liability.
Administrative Sanctions
- First time: 6 months license revocation + administrative fine
- Second: 2 years + money
- Third: 5 years + driver behavior development training
- Commercial vehicle driver: 0 promil obligation
Criminal Liability (TCK Article 179)
Endangering traffic safety by driving under the influence of alcohol: 3 months - 2 years in prison. If there is injury/death, additional punishment by consensus.
Objection to the Report
- To the Criminal Judgeship of Peacewithin 15 days (KK art.27)
- Device error, measurement procedure violation, witness evidence
Supreme Court 12. CD
12. CD emphasizes that in files where there is no calibration certificate of the alcohol measuring device, the measurement result alone is not sufficient and must be confirmed with a blood sample.
Insurance Denial
In case of an alcohol-related accident, compulsory traffic insurance pays to the third party, but the right of recourse is reserved. Insurance may reject it completely.
