TCK Articles 326-339: Crimes against the security of the State, constitutional order, national defense.

Espionage Crimes

  • Disclosing information regarding the security of the State (Article 326)
  • Providing information to a foreign state (Article 328)
  • Seizing documents regarding the security of the State. (m.330)

Punishments

  • Espionage: 15-20 years, in some cases aggravated life imprisonment
  • Obtaining state secrets: 8-12 years
  • Providing information: 5-15 years

Trial

  • High Criminal Court
  • Confidential in some files trial
  • Right to see a lawyer

Constitutional Court/ECHR

The Constitutional Court and the ECHR want the "right to a fair trial" to be protected in espionage cases, and the balance between confidentiality and the defendant's right to defense to be carefully observed.
