Obscenity and Child Sexual Abuse Content (TCK Article 226)

TCK Article 226 regulates crimes related to the production, distribution and sale of obscene content. Obscene content involving children is the most severe category.

General Obscenity (Art. 226/1-4)

  • Those who show/access obscene content to children: 6 months-2 years + criminal fine
  • Production/sales of obscene products: 6 months-2 years
  • Obscene broadcasting in broadcasting organizations: 1-3 year

Child Obscenity (article 226/3)

"Any person who uses children in the production of products containing obscene images, writings or words shall be punished with 5-10 years imprisonment and a judicial fine."

Material Containing Sexual Abuse of a Child (CSAM)

Possession, storage, sharing is a crime:

  • Production: 5-10 years + money
  • Sharing/selling: 5-10 years + money
  • Possession: 1-5 years + money

Access Blocking

Law No. 5651 is among the catalog crimes. BTK may block direct access.

International Cooperation

Active data sharing is carried out with institutions such as NCMEC (USA), Europol and Interpol. IP addresses are tracked globally.

Criminal Liability

This crime is outside the scope of settlement. Effective remorse is very limited.
