In the implementation of custody, failure to surrender the child, violation of the personal relationship decision with the child, etc. Child Surrender Centers (ÇTM) have been established for such cases.
Enforcement Way (EBL Article 25/A)
- Customer takes the court decision to the enforcement office
- The enforcement office issues a child surrender order
- Forcible child surrender may be applied to the resisting party
Use of ÇTM
The court may order the child's surrender instead of forced delivery. It may decide to transfer/deliver at the child delivery center. In ÇTM:
- Under the supervision of a pedagogue/psychologist
- Surrender of the child without trauma
- Parties not meeting face to face
Change of Custody
The party who does not surrender the child or constantly prevents the personal relationship may face the case of change of custody.
Criminal Sanction
TCK Article 234: Abduction or detention of a child - Imprisonment from 3 months to 1 year.
