  7. Decision (filing a lawsuit / non-prosecution)

Decision of Non-Prosecution

  • Insufficient evidence
  • No crime has occurred
  • No complaint (where necessary)
  • Objection: Criminal judgeship of peace within 15 days

Indictment

  • Sufficient evidence and crime formation
  • Sent to the court
  • Return of the indictment is possible (incompleteness)

Rights of the Victim

  • Hiring a lawyer
  • Presenting evidence
  • Giving a statement
  • Objection to the decision of non-prosecution
