Mandatory Mediation in Consumer Disputes (After 2024)

With the change in the law as of the end of 2023, the practice of compulsory mediation in consumer disputes has started.

Scope

  • Consumer cases over a certain amount (Consumer Court jurisdiction range)
  • Disputes involving the delivery of money, services or goods

With the Consumer Arbitration Tribunal. Difference

  • Arbitration panel: Low amount disputes (updated annually)
  • Mediation: Amounts above the arbitration panel (required before going to court)

Process

  1. Selection of mediator from the list of the Ministry of Justice
  2. First meeting within 3 weeks
  3. Process 30 days + 1 week at most extension
  4. Agreement → quality of judgment
  5. Non-agreement → final report and lawsuit can be filed (within 2 weeks)

Exceptions

  • Emergencies (precautionary measures, etc.)
  • Enforcement proceedings
  • Disputes within the jurisdiction of the Consumer Arbitration Committee
