Powers and Responsibilities of the Mediator (Law No. 6325)

The Law on Mediation in Civil Disputes No. 6325 regulates the powers and responsibilities of the mediator.

Requirements for Being a Mediator (Art.20)

  • Turkish citizen, law school graduate
  • 5 years of professional seniority
  • Mediation training (140 hours)
  • Exam
  • Ministry of Justice Registration in the Registry

Authorities

  • Bringing the parties together
  • Providing communication
  • Preparing the text of the agreement
  • Managing meetings

Limits of Authority

  • NO decision-making authority (difference from a mediator)
  • Cannot give legal advice
  • Impartial must be treated

Confidentiality

  • Statements made in mediation are confidential
  • Cannot be used later as evidence in a lawsuit
  • Criminal liability in case of violation (Art. 34)

Liability

  • Pecuniary and moral compensation for illegal mediation activity
  • Registry deletion
  • Criminal liability

Fee

It charges a fee based on the minimum wage tariff determined by the Ministry of Justice.
