If a person commits more than one crime, community rules apply. TCK art.42-44.
Types of Combination
- Intellectual communion (m.44): More than one crime with a single act → severe punishment
- Compound crime: One crime is an element of another → single punishment
- Chain crime (m.43): Repetition of the same crime with the same intention → single penalty + 1/4 - 3/4 increment
- Real combination: More than one crime → separate penalties
Chain Crime Conditions
- Same intention
- Same crime type
- Same victim (usually)
- Specified time slice
The Supreme Court CGK
The CGK adopts that the principle of "interpretation in favor of the perpetrator" should be observed in the application of the rules of assembly, and that suspicious cases should be considered a single crime.
