Unfair Provocation (TCK Article 29): Reason Mitigating the Punishment

TCK Article 29, "Anyone who commits a crime under the influence of anger or severe pain caused by an unjust act shall be sentenced to 18 to 24 years instead of aggravated life imprisonment and 12 to 18 years instead of life imprisonment. In other cases, 1/4 to 3/4 of the penalty to be imposed is downloaded."

Conditions of Unfair Provocation

  • Tort: Must have been committed by the victim (or instigator).

  • Light drive: 1/4 discount.
  • Mid drive: 1/2 discount.
  • Heavy drive: 3/4 discount.

"Duration Factor"

As the time between provocation and action increases, anger decreases; At some point, it is no longer a matter of provocation but of "design". The Supreme Court generally:

"Mutual Excitation"

In case both parties treat each other unfairly, the judge evaluates the provocation separately for each defendant; medium discount is normal.

If the defendant first acts unfairly and claims provocation based on the other party's reaction: provocation is not accepted. "The person who triggered the tort himself" cannot benefit from the provocation.
