The data owner may file a complaint with the KVKK Board when he/she experiences a KVKK violation. Administrative sanction is provided.
Complaint Conditions
- To have first applied to data controller
- Must have waited 30 days for a response (art.13)
- If the response is not satisfactory or not given, complaint
Complaint Process
- Online application via kvkk.gov.tr
- ID detection
- Application document to the data controller
- Violation declaration + evidence
- Request (deletion, correction, compensation calculation)
Decision Period
- The Board is obliged to examine the complaint within 60 days
- Time may be extended in complex files
- The decision must be reasoned
Decision Types
- If a violation is detected: administrative fine + correction order
- If there is no violation: rejection decision
- Conclusion with an explanation
Objection to the decision
- In the administrative court within 60 days from the notification of the board's decision
- Request for stay of execution is possible
