Deprivation of Inheritance (TMK art.510-513)

TMK Article 510-513: The heir may be deprived of the inheritance for certain reasons.

Reasons for Deprivation

  • Serious crime against the testator (attempted murder, etc.)
  • Grave violation of family obligations
  • Preventing the testator from declaring his will
  • No will. to/change

Form

  • It is done by will
  • Reason must be stated
  • Official form is required

Objection

  • The heir can file a lawsuit
  • He can prove that the reason is unrealistic
  • Civil court of first instance

The Destitute Heir's Share

  • Distributed to other heirs
  • The descendant of the deprived heir receives his own share

Supreme Court 14. HD

14. HD adopts that in deprivation of inheritance, "the reason must be proven with concrete evidence".
