House Arrest Decision

House arrest is one of the judicial control measures foreseen in the CMK as an alternative to an arrest warrant. It is applied in accordance with the provision of CMK article 109/3-j.

House Arrest Conditions

  • There must be a strong suspicion of crime about the suspect or defendant
  • There must be grounds for arrest
  • It should be considered that judicial control will be sufficient instead of arrest

Objection

An objection can be made against the house arrest decision within 7 days
