Pension Deposited in the Bank Account
Accumulated in the Bank There is debate about pensions. Supreme Court approach:
The Supreme Court 12th HD gives decisions that the pension "maintains its characteristic feature" by depositing it into the account, but at later dates the accumulated amount will turn into a savings account and can be seized.
Practical Recommendations
- Keep the pension in a separate account
- Use it actively. (do not accumulate)
- Objection to seizure: Enforcement court within 7 days
- Bank complaint: SGK + KVKK
Salary Transfer Agreements
- A "salary payment advance" can be received from the bank for retirement pension
- This advance is subject to seizure — attention
Orphan/Widow Pension
- Subject to the same protection as pension
- Partial seizure possible for child support
