Attorney Fee in Enforcement Proceedings: AAÜT Tariff

Lawyer Minimum Fee Tariff (AAÜT) determines the fees to be paid to creditor and debtor lawyers in enforcement proceedings. It is updated by TBB every January.

Types of Enforcement Attorney Fees

  • Proceeding attorney fee: Fee added to prosecution costs
  • Collection attorney fee: Additional fee received when collected
  • Opposite party attorney fee: Debtor pays

Calculation

  • % rate on receivable value
  • Below 10,000 TL: minimum fixed fee
  • 10,000-100,000 TL: 10-15%
  • 100,000+ TL: gradually decreasing rate

Debtor's Responsibility

Follow-up When it is finalized, the debtor must pay the receivable + interest + attorney fee.

Supreme Court 12. HD

12. HD accepts that the attorney's fee "cannot be below the APR", but in special cases a higher agreement can be made between the parties.

Client-Lawyer Relationship

  • The attorney fee agreement must be made in writing
  • The lower limit of the APR
  • Success bonus is possible (according to the agreement)

Dispute Solution

In attorney fee disputes, bar association arbitration committees come into play first.
