TCK Article 148: A person who takes the property of another person by forcing or threatening him/her commits the crime of plunder.
Penalties
- Simple plunder: 6-10 years in prison
- With a gun: 10-15 years
- Multiple people: 7-15 years
- Bank/jeweller robbery: 10-15 years. year
- Looting in residence: additional aggravation
Difference with Theft
- Theft (TCK art.141): Victim is unaware/asleep
- Loot (TCK art.148): Taking by force/threat
- Looting is more severe
Looting Elements
- Preventing the resistance of the victim
- Property in the possession of the victim
- Force or threat (weapon, physical force)
- Unlawful seizure
Supreme Court 6. CD
6. CD adopts that the causal link between "force/threat-taking" in looting should be clear and that separate acts will be evaluated as separate crimes.
