Article 244/2 — Corrupting/Destroying/Altering Data
Data in the information system Imprisonment from 6 months to 3 years for the person who corrupts, destroys, alters or renders inaccessible. 2-6 years imprisonment in case of gaining a benefit.
Ransomware Attacks
Encrypting the company's data with Ransomware (ransomware) and demanding ransom:
- TCK Article 244/2 (making data inaccessible)
- TCK Article 107 (blackmail)
- TCK Article 158/1-f (fraud with information system)
Multiple criminal charges are applied.
Supreme Court 8th CD
8. CD adopts that in ransomware attacks, the perpetrator's functional limit should be taken into account, and that the purpose of gaining profit should be evaluated, not just blocking access.
