Online Copyright Infringement: YouTube/Instagram Content Stolen

Video, photo, music, text, etc. on social media platforms. Unauthorized use of the content constitutes copyright infringement within the scope of the Law on Intellectual and Artistic Works (FSEK).

Sanctions in Turkish Law

Legal Sanctions (FSEK art.66-68)

  • Prohibition of rape and refi lawsuit
  • Material and moral compensation
  • Right to claim triple compensation (FSEK article 68)

Criminal Sanctions (FSEK art.71)

  • Unauthorized reproduction, dissemination, sale: 1-5 years imprisonment
  • Violation of the moral rights of the author: within the same scope

Burden of Proof

The right holder proves that the work belongs to him/her and that it has been used without permission. Pre-registration documents (Registration by the Ministry of Culture of the Republic of Turkey), publication dates, blockchain-based timestamps are useful.
