Article 6 of the Electronic Commerce Law No. 6563 prohibits the sending of commercial electronic messages without the prior approval of the recipient.
What is IYS?
Message Management System (IYS) is the official system in which service providers record the approvals they receive. It is managed through iys.org.tr.
Conditions of Approval
- With clear and free will
- For which medium (SMS, e-mail, call)
- For which type of content (campaign, product, service)
- Registration to IYS within 3 business days
Exceptions
- Merchants/tradesmen buyers (but right of rejection reserved)
- Scope of ongoing customer relationship (related to own products)
- Due to legal obligation
Sanctions
- Unapproved message: 1,000-5,000 TL (each message for)
- If sent in bulk: 5,000-10,000 TL
- Complaints are made to the Ministry of Commerce
Relevant KVKK Dimension
Commercial message approval is separate from KVKK express consent. Two separate approvals must be obtained.
