Unjust Enrichment (TBK art.77-82)

TBK Article 77: A person who becomes enriched at the expense of someone else without a legal reason is obliged to return the enrichment.

Conditions

  • Enrichment of one person
  • Damage of another
  • Absence of legal reason
  • Link of Causality

Those that cannot be returned (TBK Article 78/2)

  • Payment of a debt that is time-barred
  • Moral duty payment
  • Payment by a person who knows that there is no debt

Duration

  • 2 years without knowing it, 10 years in any case

13. HD accepts that in unjust enrichment, it is necessary to prove "absence of legal reason".
