Notice Compensation: Periods and Calculation (Labor Law Article 17)

Labour Law Article 17: A notice period must be given before the employment contract is terminated.

Notice Periods

  • 0-6 months: 2 weeks
  • 6 months - 1.5 years: 4 weeks
  • 1.5 - 3 years: 6 weeks
  • Over 3 years: 8 weeks

Notice period Non-compliance

  • If the employer does not give the time, he pays notice pay
  • If the employee does not comply with the time, he pays it to the employer (usually)
  • Amount: time × daily gross wage

Unjustifiable Situations

  • Termination for just cause (article 25)
  • Trial period (2 months usually)

Right Circumstances

  • Termination for valid reason (incompetence, behavior)
  • Economic termination
  • Special reason for termination of the contract

Supreme Court 9. HD

9. HD accepts that notice pay is "complementary, not alternative" and that paying compensation is the protection of the right even if a termination period is allowed.
