Mobbing (Workplace Intimidation): Detection and Compensation

Mobbing is systematic psychological pressure/intimidation in the workplace. Labor Law Article 5 and TBK Article 49.

Symptoms of Mobbing

  • Continuous humiliation
  • Hiding job information
  • Exclusion from work
  • Excessive workload/not giving work
  • Reduction of authority
  • Interference with performance

Continuity Condition

  • One-time event insufficient
  • Weekly for at least 6 months
  • Systematic quality

Rights

  • Termination for just cause (Labor Decree, Art. 24/II)
  • Severance pay
  • Pecuniary damage
  • Notice pay (none, just cause)

Proof

  • Witness (work friends)
  • E-mail/message records
  • Health report (depression)
  • HR complaints

Supreme Court 9th HD and 22nd HD

9. HD adopts that mobbing should be "systematic and continuous" and that high moral compensation should be given to the victim.
