SGK Law No. 5510 requires every employed person to be insured and notified to SSI 1 day before the starting date of work at the latest.
Notification Obligations
- Declaration of employment: 1 day in advance
- Declaration of termination of employment: 10 days. in
- Monthly premium and service certificate (APHB): Until the 23rd day of the following month
- Accrual and collection: Last day of the relevant month
Unregistered Employment Sanctions
- Administrative fine: minimum wage per person
- 5-year retroactive premium for the insured who has not been notified accrual
- Employer liability is increased in case of worker complaint
- It may trigger a tax audit
Worker's Rights
The worker can claim his/her past rights from the SSI and the employer by proving that he/she is employed without insurance. He/she can terminate the employment contract for justified reason and receive severance pay.

9. HD and 21st HD accept that in allegations of unregistered employment, evidence such as witness statements, wage slips, bank account movements will be evaluated together, and the employer's defense of "there is no record" will be interpreted adversely.
