TKHK Article 50: In timeshare and timeshare contracts, the consumer has 14 days right of withdrawal.
Right of Withdrawal
- 14 days without justification
- Starts from the date of the contract
- All fees paid will be refunded
Condition of the Contract
- Written form mandatory
- Duration, place of use, type of right are clear
- Otherwise invalid
- Right of withdrawal certificate must be given
Annual Fee
- Annual dues are mandatory (specified in the contract)
- Consumer can file a lawsuit against excessive increase
Timeshare Transfer
- Deeded (floor) easement/condominium ownership)
- Additional fee on transfer
- Dues extend into the past
Problem Companies
- Those who show a model but do not deliver it
- Relocated
- Excessive increase in dues
- Representing the old building as new
Supreme Court 13. HD
13. HD accepts that "door sales" and "misleading advertising" provisions can be applied together in timeshare/timeshare sales, and the consumer can request a refund within his rights.
