Cancellation and refund rules for transportation tickets sold online vary depending on the type of ticket.
Ticket Types
- Flexible ticket: Generally refund/exchange possible, price high
- Promotion/non-refundable: Low price, strict rules
- Standard: Refund with a certain penalty
"Non-refundable" Ticket Discussion
Despite the "non-refundable" claim, there is a right to a refund in some cases:
- Operator's flight/train cancellation
- Force majeure (illness, death - with documentation)
- Missing a connecting flight (caused by the operator)
Right of Withdrawal?
Among the distance sales withdrawal exceptions are "transportation for a certain date" service" (TKHK article 50). However, the operator's non-refundable policy can be objected.
Reasons for Cancellation
- Operator's cancellation: full refund + additional compensation
- Consumer's cancellation: according to ticket class
- Force majeure: refund if documented
Supreme Court 13. HD
13. HD accepts that the "non-refundable" condition constitutes "unfair practice" when the ticket is not used due to force majeure, and the consumer may request a refund.
Complaint Process
- Written refund request to the operator
- Document submission (health report, death certificate)
- DGCA (for aircraft)
- Consumer arbitration committee / court
