Holiday Cancellation and Contract Violation by the Tourism Agency

When the tourism agency does not provide the holiday service in the contract, the consumer has the right to refund + compensation.

Types of Violation

  • Change of hotel (to lower category)
  • Reduction of half board to "breakfast only"
  • Cancellation of activity/tour
  • Change of ticket category (flight)
  • Accompaniment rejection

Complaint Process

  1. Immediate written record of the victimization during the holiday
  2. Notification to the agency (SMS/e-mail)
  3. The hotel's signing of the minutes
  4. TÜRSAB complaint
  5. Consumer arbitration committee / court

13. HD accepts that the agency's organization responsibility is heavy in the package holiday contract and that in case of changing the hotel, a reasonable proportional discount + non-pecuniary compensation must be given.

Pecuniary Compensation

The purpose of the holiday is "rest and entertainment". Failure of this purpose will cause moral damage.
